The Association has the power and authority to enforce “restrictive covenants” that govern landscaping, changes to homeowners lots, and how homeowners use their lots. The Capital Court Architectural Covenants Committee (ACC) is the review entity by which the Board of Directors has assigned the rights and powers under Article 8 of the Capital Court Declaration of Covenants, Conditions, Easements and Restrictions (“Declaration”) to review and approve changes to Lots within the Community. The Board also employees the management company to assist homeowners with their application, issue violation and fine notices, and to answer questions in the Covenant and Rule Enforcement Policy.

What are Covenants?
Covenants are a binding contract for all homeowners. They assure homeowners maintain a certain minimum standard for architectural design, land use, and property maintenance throughout the community. When considering exterior alterations on your property, you should review the governing documents.
Design Review and Architectural Control
The Declaration contains specific restrictions (“Restrictive Covenants”) on what changes may be made, and how they may be made. It requires homeowners to obtain approval from the ACC before performing most exterior changes. The promulgation and enforcement of environmental and design standard and guidelines is intended to achieve the following objectives:
Maintain consistency with the overall design concept for the community;
Promote harmonious architectural and environmental design qualities and features;
Promote and protect the owners’ and occupants’ use and enjoyment of the lots;
Promote and enhance the visual and aesthetic appearance of the community.
Per the Declaration, Section 8.1 Architectural Approval, “No construction or development activities, including, without limitation, staking, clearing, landscaping, excavation, grading or other site work shall be commenced, erected or maintained within the Property, and no exterior addition, change or alteration of any nature to the Lots or other existing improvements within the Property, including without limitation, changes in color, changes or additions to driveway or walkway surfaces and landscaping modifications, shall be commenced, erected or maintained unless and until complete plans and specifications for Improvements have been approved, in writing, in accordance with the applicable provisions of this Article.”
Design Guidelines
The Capital Court Architectural Covenants Committee Procedures and Architectural Guidelines: A Guidebook for Homeowners (“Design Guidelines”) explains the application and review process which must be adhered to by homeowners who wish to make any exterior changes (including additions, deletions and other changes) to their homes or lots, which are subject to approval by the ACC.
The ACC may from time to time, in its sole discretion, determine that certain item(s) shall not require approval by the ACC in accordance with Section 8.5 of the Declaration and any such determination shall not act as a waiver of the ACC’s right to require approval of applications for the same item(s) or other items for time to time.

Homeowners will be notified by the HOA management company of the ACC’s decision by email and/or a letter to their home.
